Terms of Use — YesWater

1. General Provisions
1.1. These Terms of Use ("Terms") govern your access to and use of the YesWater mobile application ("App"), owned and operated by the Owner ("Owner," "We," "Us," or "Our").
1.2. By downloading, installing, or using the App, you confirm that you have read, understood, and agree to comply with these Terms. If you do not agree, you must stop using the App and delete it from your device.
1.3. These Terms constitute a legally binding agreement between you ("User") and the Owner.
1.4. The App is available exclusively on iOS devices.

2. License and Restrictions
2.1. The Owner grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App for personal and non-commercial purposes, subject to these Terms.
2.2. You are prohibited from:
- Copying, modifying, distributing, or creating derivative works of any part of the App without prior written consent.
- Reverse engineering, disassembling, or attempting to extract the source code, except where explicitly permitted by law.
- Using the App in any unlawful manner or in violation of these Terms.
- Attempting to bypass technical restrictions or access features without proper authorization or valid subscription.

3. Subscriptions, Purchases, and Payments
3.1. The App operates on a freemium model. Some features are available free of charge, while premium features require a paid subscription or a lifetime purchase.
3.2. Premium access is provided through:
- Annual auto-renewable subscription
- One-time lifetime purchase
3.3. Subscriptions are managed and billed by the App Store in accordance with Apple's policies. The Owner does not store or process payment information.
3.4. Subscriptions renew automatically unless cancelled at least 24 hours prior to the end of the current billing period.
3.5. You may manage or cancel your subscription at any time through your App Store account settings.
3.6. If a subscription expires, access to premium features is revoked, while free features remain available.
3.7. No guarantees are provided that promotional or discounted prices will be available in the future.

4. Health Disclaimer and Limitation of Liability
4.1. The App is a hydration tracking tool intended solely for informational and self-monitoring purposes.
4.2. The App is not a medical device and does not provide medical advice.
4.3. The App is not a substitute for professional medical consultation, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any health-related concerns.
4.4. Any calculations, recommendations, reminders, or goals generated by the App are approximate and depend on user-provided data. The Owner is not responsible for inaccuracies caused by incorrect or incomplete user input.
4.5. The App is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
4.6. The Owner is not liable for any direct, indirect, incidental, consequential, or special damages resulting from:
- use or inability to use the App
- reliance on any content or calculations provided by the App
- loss of data or subscription access
- technical failures, errors, or interruptions
4.7. You use the App solely at your own risk.

5. Intellectual Property
5.1. All intellectual property rights in the App—including but not limited to the design, UI/UX layouts, illustrations, characters, images, icons, logos, and the YesWater brand—are owned exclusively by the Owner.
5.2. You may not copy, reproduce, distribute, modify, or use any intellectual property contained in the App without prior written permission from the Owner.
5.3. Any unauthorized use of the App's intellectual property is strictly prohibited and may result in legal action.

6. Privacy
6.1. The App does not collect, store, or process any personal data.

7. Termination of Use
7.1. The Owner reserves the right to suspend or terminate your access to the App at any time without notice if:
- you violate these Terms
- you attempt to misuse the App or its premium features
- fraudulent activity is suspected
7.2. Upon termination, all rights granted to you under these Terms immediately cease, and you must delete the App from your device.
7.3. The Owner reserves the right to discontinue or modify the App, including premium features, without prior notice and without liability.

8. Changes to the App and Terms
8.1. The Owner may update, modify, or discontinue any functionality of the App at any time without prior notice.
8.2. These Terms may be updated periodically. Continued use of the App after changes are made constitutes acceptance of the revised Terms.
8.3. The "Last updated" date reflects the most recent version.

9. Governing Law
9.1. These Terms are governed by general principles of international digital consumer agreements, without reference to any specific jurisdiction.
9.2. If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain in full force and effect.
